PUBLIC OFFER AGREEMENT
The text of the Agreement is an official public offer (in accordance with the provisions of the point 641 of the Civil Code of Ukraine) of the «PEI «CLARIS VERBIS GYMNASIUM» LIMITED LIABILITY COMPANY (hereinafter referred to as «SCHOOL») and addressed to an unspecified circle of persons and companies visited the website https://www.educare.org.ua/, (hereinafter – «DONORS») enter into an agreement about donation on the terms established by the School. The Agreement is considered to have been concluded in accordance with the provisions of the point 642 of the Civil Code of Ukraine and takes effect as an accession agreement from the moment the Donor performs the actions provided for in this Agreement which means the Donor’s full and unconditional acceptance of all the terms of the Agreement without any exceptions and/or limitations (acceptance).
1. General provisions
1.1. Each of the Party guarantees to the other Party that it has the necessary legal capacity as well as all the rights and powers necessary and sufficient for the conclusion and execution of the Agreement in accordance with its terms.
1.2. The current version of this Agreement is always posted on the School’s website and is available for review by the Donor and his acceptance of the terms of the Agreement.
2. Terms
2.1. Acceptance – is full and unconditional acceptance of this public offer by taking actions to make a money transfer using the payment forms and means posted on the website as well as by transferring funds to the School’s banking account through banks. The moment of acceptance is the date of transfer of funds to the School’s banking account.
2.2. Voluntary donation – making a money transfer by the Donor to finance the payment of scholarships* for students to study at the School. The donation can`t be used for other purposes.
2.3. Payment is a voluntary donation. The donor independently determines the size of the donation. The suggested donation for online learning is: £100; recommended donation size for offline training is: from £300.
*The scholarship covers the costs of studying at the School offline or online. The scholarship for offline study at the School for students to complete a full-time education, receive food and field lessons in the city of Kyiv etc. The scholarship for online studies at the School provides students with a continuous educational process in an online format.
The scholarship in the amount of £100 is the monthly education fee for one student in the online format at the School. The annual value of such a scholarship is: £1200
The scholarship in the amount of £300 is the monthly education fee for one student in an offline format at the School. The annual value of such a scholarship is: £3600.
The scholarship can be paid in one payment for the entire academic year.
3. Subject of the Agreement
3.1. The subject of this Agreement is the free transfer of funds by the Donor in favor of the School to finance the payment of scholarships for students to study at the School.
3.2. The acceptance of the Agreement means that the Donor agrees with all its provisions and he is fully aware of the subject of the Agreement and the purpose of collecting the donation.
3.3. Donation is voluntary and non-refundable.
3.4. The donor is responsible for the accuracy of the information provided when transferring the donation.
3.5. The Donor agrees that the donation made for a scholarship for the education of a certain student at the School may be redistributed and used to award scholarships to other students of the School.
4. The rights and obligations of the Parties
4.1. The School has the right to receive donations and use them to finance the payment of scholarships for students to study at the School.
4.2. The school is obliged to provide a report on the donation received and its use at the request of the Donor.
4.3. The Donor has the right to transfer the donation to the School’s banking account as determined by this Agreement.
4.4. The Donor has the right to request a report on the use of the donation.
5. Other provisions
5.1. The Donor declares that he understands all the terms of this Agreement and accepts them unconditionally and in full.
5.2. The Parties undertake to be guided by the norms of the current legislation of Ukraine on issues that are not regulated by this Agreement.
5.3. The Donor gives the School his consent to the processing of his personal data entered on the website by signing this Agreement during the registration and payment of the donation in accordance with the Law of Ukraine «On the Protection of Personal Data» dated 01.06.2010 № 2297-VI.
